Benson Obodeh’s Killing: Appellant, Adedeji Adeleke In Rush To Appeal Court Over Looming High Court Judgment

Dismissed Police Corporal Adedeji Adeleke, who was one of the accused Killer of A car Dealer, Benson Obodeh in 2015, is at crossroad seeking refuge at the appeal Court.

The accused Adeleke is standing trials alongside Four others at the Edo State Criminal Court Five sitting in Benin, over a 10-count of Conspiracy, Murder, Stealing and extortion.


The Appellant in the Court of Appeal in the Benin Judicial Division with suit No CA/B/4000/2019 Filed for appeal on a no case submission praying the court that he has no case to answer.

Adeleke who is the first defendant and Ring leader in the suit No B/CD/48C/2016 versus the State, is said to have bluntly refused to enter his defense at the trial Court.

He had been accused of coming up with frivolous applications from the Edo State High Court, Federal High Court Benin Division and Court of Appeal Benin Division, on ground of ill health and as well as bail applications.

However, after failed coups and further knowing he couldn’t get his desired bail amidst gripping hooks swinging and seemingly perforating his beliefs, he again file for no case submission this time, urging the appeal court of Justice to dismiss the case while it’s concurrently running at the Criminal Court sitting in Benin City.

His previous attempts to pervert justice through his no case submission had been overruled and turned down while he was advised to face his case.

Adeleke has deliberately refused to enter his defense that provided 17-witness against him and his Co-travellers.

The other four defendants, have since opened and closed their defenses since 7/6/2016.

For the First Appellant,(Adeleke Adedeji), who allegedly led other four to commit the heinous act before they were arrested and investigated at the inception of the case has refused to enter his case.

Although, the Appellant reserves the Constitutional right to seek appeal to convince the court of no case submission.

But with the admissible evidences tendered by the claimants or Respondents to prove the essential ingredients of offence, he seems to stand no chance of getting a favourable judgement.

Recall that, after allegedly gruesomely murdered the now deceased Benson Obodeh in their custody few hours after he was alleged of car theft, Adeleke and his Subordinates took the ATM card with evidence, went to Port Harcourt and stole from his First Bank account No 3070150149 in three installments of N20, 000, N40, 000, and N40, 000 respectively.

Not done, evidence also provided by ATM footage revealed the face of the accused Adeleke Adedeji as he subsequently withdrew in another five installments, N20, 000 respectively in May 25, 2015.

In another evidence provided by the Prosecutors (Respondents), shows that, the defendants at the trial, also used the deceased ATM card to Transfer some money into a GTB bank account No. 0011009936 belonging to one Kazeen Adesina Fassasi.

The Appellant and first defendant through his Solicitor, Barrister P E Uwadia before the Three panel judges led by Hon Justice P.M Ekpe, Prayed the Court to dismiss the case over what he claimed to be no case submission.

But the Solicitor to the Respondents, however, in a counter response, urged the court to ignore the call by the first defendant’s Counsel.

They argued that, with the series of evidences provided against the Appellant who has refused to enter his defense to explain what happened to the deceased from when he picked him in the Morning of 21/5/2015 till he died in the same evening, it is enough to compel Adeleke to face the 10-count charges leveled against him at the Criminal Court Five(5) Benin Division.

Having carefully listened to the arguments and submissions of the Solicitors, Hon Justice PE Ekpe who led two others in the three-man- panel, reserved judgement.

Recall that, late Benson Obodeh was murdered over an alleged car theft in Benin City in early may, 2015 by the dismissed police corporals attached to Special Anti Robbery squared, SARS, Lagos State Command

The accused, Adeleke Adedeji, Musa Oniyo, Abena John, Henry Shobowale and Joseph Omotosho are being tried on a Ten-count charge

Investigating Police Commissioner and a medical doctor, during the cross examinations, testified before Criminal Court Five, in Benin City in the trial of the five dismissed policemen over alleged murder of Benson Obodeh, a Benin based 26-year-old car dealer.

The two other prosecuting witnesses were Dr. Godwin Abeng Boke and a Specialist Forensic Pathologist,(name withheld), a Commissioner of Police in Charge of Pathology for the police nationwide.

Dr. Godwin Abeng Boke, a pathologist with University of Calabar Teaching Hospital, (UCTH) told the court presided over by Justice Ohimai Ovbiagele that, he was appointed to lead a team to carry out a postmortem on late Benson Obode after he was identified by his elder brother, Mr. Solomon Obode, as he was deposited in a Central Hospital mortuary by same rampaging and now dismissed police officers with another name inscribed in his lifeless body to cow his family.

He said the autopsy was carried out on 30th September 2015, four months and few days Benson Obode was killed under a controversial circumstance.

According to Dr. Godwin Abeng Boke’s testimony, the deceased suffered multiple blood injuries inflicted using objects.
