The former Minister of aviation, Mr. Femi Fani-Kayode has contended that the judge handling his case, Judge M. S. Hassan should be deprived of jurisdiction to continue.

It could be recalled that in 2008, the now judge, Barr. M. S. Hassan was an employee of the Economic and Financial Crimes Commission who charged and tried Fani-Kayode in the Federal High court, in a 47 count criminal charge in Charge No: FHC/L/523C/2008 Federal Republic of Nigeria V. Femi Fani Kayode at the Lagos Division on behalf of the Federal government,
Barr. Hassan prosecuted Fani-Kayode for a period of about 7 years until the 1st of July 2015 when the accused was discharged and acquitted by the court in respect of the charged.
The former aviation Minister who, in his current prosecution believed that his Lordship, M.S. Hassan presiding over his current case had previously superintended a criminal charge against him for the same EFCC therefore cannot be fair in his judgement
Speaking with NAIJA CENTER NEWS, a source who didn’t want to be named said “The judge in Fani-Kayode’s case prosecuted him for the EFCC for 7 years. He signed the charge sheet in 2008 so he was effectively the accuser and the prosecutor.
“One year after he was acquitted by the courts this same man is now appointed a judge and is presiding as judge over another case he has with the EFCC.
“It is unfair and unconstitutional and he is biased. He should never have taken the case in the first place but was smuggled to his court quietly by Rotimi Oyedepo who is the prosecutor for the EFCC.
“It is on this ground and a few others that his counsels are asking that the case be removed from him and taken to another judge in Abuja.”
