Former Kiambu Governor Ferdinand Waititu has hit a snag after the High Court decided not to overturn his 12-year prison sentence related to corruption charges.
Lady Justice Lucy Njuguna delivered the ruling on September 16, 2025, rejecting an application that Waititu had filed on August 28, 2025. The application sought to review and dismiss the sentence handed down in February of this year. The judge stated that the sentence will stay in effect while his appeal is being heard and decided.
Waititu was found guilty of improperly receiving Ksh25 million ( USD 192,000) from Testimony Enterprises following the awarding of a problematic county tender. He was given the option to either pay a fine of Ksh53.5 million ( USD 412,000) or serve 12 years behind bars.
Unfortunately, he couldn’t meet the bond conditions that required him to provide a Ksh53 million (approximately USD 408,000) bank guarantee, which is why he remains in Kamiti Maximum Prison.
“The court sees no grounds to review the sentence. The case will move forward to appeal, which must be heard and resolved within 120 days,” Justice Njuguna ruled.
The Director of Public Prosecutions (DPP), who firmly opposed Waititu’s request, praised the ruling as a victory for accountability and justice in the ongoing battle against corruption.
Waititu’s case is set to be mentioned again in court on October 1, 2025, as all parties gear up for the full appeal hearing.
