The Judicial Service Commission (JSC) has acknowledged that it is currently reviewing five petitions seeking to remove ten judges from office for their involvement in a long-running land dispute case.
Mr. Kung’u Muigai submitted the petitions on October 11, 2024, and they originate from a case filed in 1992.
The case, HCCC 1219 of 1992, was litigated at many levels of the judicial system, including the High Court, Court of Appeal, and Supreme Court, and involved both active and retired judges.
In a statement released on November 26, 2024, the JSC said it received the petitions but highlighted that the case is being addressed in strict conformity with Kenya’s Constitution and the Judicial Service Act.
However, the commission voiced alarm about media reporting, particularly a Daily Nation headline claiming that the judges were being removed over a Ksh. 3 billion land feud.
The JSC alleges that the article unduly harmed the reputations of the participating judges and gave a sensationalized, biased narrative based only on the petitioner’s assertions.
In addition, it said the report made assumptions about the petitions’ possible outcomes before the case had been fairly decided.
“While the petitions are being processed in strict adherence to the Constitution of Kenya and the Judicial Service Act, the JSC takes exception to the Daily Nation’s coverage of this matter, which presents a sensationalised and one-sided account based solely on the petitioner’s claims, unfairly exposing the Judges in question to reputational damage,” said the Judicial Service Commission (JSC).
