A Kenyan court has handed a man life imprisonment over defiling his underage niece that resulted in a pregnancy and birth of a child.
The accused commit the heinous act on December 16, 2020, in Nakuru, northwest of Nairobi.
Nyahururu Senior Resident Magistrate Vincent Kiplagat declared in his ruling that the prosecution established its case against the defendant beyond a reasonable doubt.
According to Kiplagat, he relied on the evidence presented to the court. Eyewitnesses linked the man to the act.
The court also used medical report to determine the case.
“DNA profile samples generated as per the report of Government Chemist dated January 2023 linked the accused with 99.9 per cent to being the biological father to the minor born out of the offence.The court in its conclusion linked the accused to be the perpetrator of the heinous act,” said the magistrate.
Kiplagat said the girl endured unspeakable trauma at the hands of the uncle and will carry this trauma with her for the rest of her life.
The accused individual took advantage of the youngster because he was paying her school fees and would conduct the act repeatedly when the girl went to collect school funds from him, according to the court. The accused has been granted 14 days to file an appeal.
