Kenyans Warned Against Online Incitement

Kenya’s Directorate of Criminal Investigations (DCI) has warned Kenyans against spreading misinformation and hatred on social media platforms.

In a statement, the DCI said that whereas the freedom of expression is guaranteed in the Kenyan constitution, its enjoyment should not be used to promote and justify mayhem and lawlessness.

The agency said inciting Kenyans to cause lawlessness is against the constitution, and everyone found liable will face the full wrath of the law.

“In this regard, the DCI wishes to advise that online incitement to violence falls out of the spectrum of constitutional protection and is criminal as per Sections 22 and 23 of the Computer Misuse and Cybercrimes Act of 2018,” said the DCI.

“The DCI shall continue to execute its mandate as prescribed by law, and will process any law breakers for prosecution without fear, favour or ill will.”

Sections 22 (1) and (2) state that anybody found guilty of knowingly disseminating incorrect, misleading, or fabricated data or disinformation faces a fine of up to Ksh5 million ($35298) or imprisonment for up to two years, or both.

The warning comes ahead of the three-day anti-government protests across the country. The demonstrations are organized by the opposition.
