A Kenyan court has sentenced a man to 30 years in prison for manslaughter after he poisoned his children, Edwin Oluoch and Ronald Ochieng, amid marital disputes.
The ruling, delivered by Lady Justice Mwanaisha Shariff, highlighted the severity of the crime, which resulted in the death of one of the children.
The case initially saw Okeyo charged with murder under sections 203 and 204 of the Penal Code. However, the accused’s legal representative initiated plea negotiations during the proceedings.
The prosecution accepted the plea deal, and Okeyo subsequently pleaded guilty to the lesser charge of manslaughter, as defined in section 202 and read with section 205 of the Penal Code.
Following his admission of guilt, the probation office prepared a presenting report. The accused was then allowed to present mitigating circumstances, and both the defense and prosecution made submissions on sentencing.
Prosecutor Mercy Mutheu Muema emphasized the gravity of the crime, underscoring the societal implications of a father ending his child’s life.
She argued for a custodial sentence to serve as a deterrent to others.
In her judgment, Lady Justice Shariff condemned Okeyo’s actions, stating that he had failed in his fundamental duty to protect his children.
Instead, he had chosen to end his child’s life prematurely. She reiterated that the safety and well-being of family members, especially children, should always be paramount.
