The Court of Appeal has overturned the High Court’s ruling that nullified the election of Lagdera Member of Parliament (MP) Abdikadir Hussein Mohamed.
In a Friday ruling, judges Kathurima M’inoti, Hellen Omondi and Ngenye Macharia said Hussein was validly elected.
The judges ruled that the deviations disclosed by the scrutiny were within the permissible ranges and were not significant enough to warrant re-election.
“His elections represent the will of the people,” ruled the judges.
Hussein of the Orange Democratic Movement (ODM) was declared the winner by the electoral commission on August 9, 2022 elections.
He garnered 5939 votes, defeating his three opponents. His closest rival, Abdiqani Zeitun, got 4,863 votes.
