Man Sentenced to 30 Years for Sexual Assault of Minor in Kisumu County

The Tamu Law Courts have sentenced Dan Otieno Kaye, a 45-year-old man, to 30 years in prison for the sexual assault of a 14-year-old girl.

The sentencing was handed down by Resident Magistrate Hon.

Maureen N. Olonyi after thoroughly considering the case details and testimonies.

Kaye was found guilty of committing the offence on multiple occasions between November 3, 2023, and February 2, 2024, in Koru Township, Muhoroni Sub-County, Kisumu County.

The court’s decision came after a comprehensive review of testimonies from four prosecution witnesses, which confirmed the accused’s deliberate and unlawful actions.

Magistrate Olonyi based her judgment on three critical factors: the age of the victim, evidence of penetration as defined by Section 2(1) of the Sexual Offences Act, and the clear identification of Kaye as the perpetrator.

The prosecution presented compelling evidence that included testimonies from the minor and three other witnesses, establishing Kaye’s guilt beyond a reasonable doubt.

“The court has found that the accused exploited the vulnerability of the minor, deceiving her with false promises of marriage,” Magistrate Olonyi stated.

She emphasized that the severe sentence reflects the seriousness of the crime and the need to protect minors from such exploitation.
