Two Men Convicted Of Robbery With Violence

Kibera Law courts convicted two men on Friday for the offence of Robbery with violence contrary to section 296 (2) of the Penal Code.

James Wachira Kibe and Erick Njuguna Kamau were convicted by Senior Principal Magistrate, Hon. Boke.
The third accused person was acquitted due to insufficient evidence.

The court heard that the accused persons, while armed with dangerous weapons, shot one PC Titus Musyoka Thitu, driver of the Deputy Chief Justice, on October 28, 2017, at around 1600hrs along Ngong road opposite Impala club, Dagoretti Sub County within Nairobi, whereby they robbed him of his Jericho pistol.

The prosecution called a total of 11 witnesses who positively identified the suspects and were found in possession of the firearm robbed from the victim during another robbery incident that occurred later on in Thika.

The matter will be mentioned on October 27 2022, for sentencing.
